This article aims to demonstrate the challenges of Collective Labor Law in the context of the post-industrial society, marked by the fragmentation of professional categories that are the basis for sustaining a system of minimum labor guarantees. It aims to prove the power of knowledge workers and their ability to rebuild the trade union movement as in its origin, that is, truly emancipatory and counter-hegemonic. Collective struggles in recent centuries have become merely vindictive, especially with the advent of the welfare state. The Information Revolution has subverted the Fordist capitalist paradigm, and in this scenario new actors have emerged who play the game of forces between capital and labor. The class struggle, based on syndicalism of a workers' character, no longer responds to the wishes of the workers of post-Fordist society, who must adapt to the new social context in order to reestablish its strength. To this end, the trade union movement must aggregate not only the knowledge workers, but also the proletariat, the unemployed and the unemployed, struck by structural unemployment.
