المستخلص:

تتناول هذه الدراسة التحديات القانونية الناشئة عن تطور الذكاء الاصطناعي وقدرته المتزايدة على توليد أعمال إبداعية. تهدف هذه الدراسة لبحث إمكانية اعتبار الذكاء الاصطناعي مؤلفًا للأعمال التي ينتجها في النظام السعودي، وذلك من خلال اتباع المنهج التحليلي لنصوص الأنظمة ذات العلاقة، حيث تلقي الدراسة نظرةً على ماهية الذكاء الاصطناعي، والطبيعة القانونية له، وماهية المؤلف وفقًا للنظام السعودي وتكييف الذكاء الاصطناعي. من أهم نتائج هذه الدراسة أن مفهوم المؤلف في النظام السعودي مرتبط بشكل وثيق بالشخصية القانونية مما يجعل من الصعب اعتبار الذكاء الاصطناعي مؤلفًا في النظام السعودي. كما خلصت هذه الدراسة إلى أن الذكاء الاصطناعي يعتبر أداة في يد المؤلف خلال عملية التأليف، وبالرغم من ذلك فهو أداة مميزة تستدعي استحداث تنظيم خاص به. أوصت الدراسة بضرورة إجراء المزيد من البحوث والدراسات لتحديد تأثير دور الإنسان ومدى مساهمته في عملية الإبداع التي يشترك فيها الذكاء الاصطناعي على حماية المصنف، بالإضافة إلى ضرورة تطوير الأنظمة القانونية القائمة لتشمل أحكامًا خاصة تحكم حقوق الملكية الفكرية للمصنفات التي تستخدم الذكاء الاصطناعي، واستحداث تنظيم خاص للمصنفات الناتجة عن الذكاء الاصطناعي.

Abstract:

This study addresses legal challenges arising from the development of artificial intelligence and its increasing ability to generate creative works. The aim of this study is to explore the possibility of considering artificial intelligence as an author of the works it produces within Saudi law, by analyzing relevant laws. The study examines the nature of artificial intelligence, its legal status, the concept of an author under Saudi law, and how artificial intelligence is classified. One of the key findings of this study is that the concept of authorship in Saudi law is closely tied to the legal personality provisions, making it is difficult to consider artificial intelligence as an author. The study concludes that artificial intelligence should be regarded as a tool during the creative process by the author. However, it is a distinct tool that calls for specific regulations in this regard. The study recommends further research to determine the impact of the human role and contribution in the creative process involving artificial intelligence on the protection of the work. It also calls for the development of existing legal law to include special provisions governing intellectual property rights for works used artificial intelligence; as well as, there is an urgent need for a specific regulation for works produced by artificial intelligence.
