The people who are living in the Himalayan region of Sikkim having their Lingua-franka “Nepali” are the aboriginal tribe of Sikkim. Within the Nepali community, there are many local dialects for their communication however this  community is a single entity as Nepali (Gorkhali).

Back to the history, the vast land of Nepal renounced by the Rajah of Nepal after the signing the treaty of Segowlee on the 2nd day of December 1815. The treaty  received by the East India Company from Chunder Seekur Opedeea, Agent on the part of the Rajah of Nipal, in the valley of Muckwaunpoor, at half past two o’clock p.m. on the 4th of March 1816 where the article 2nd of the treaty ceded the sovereignty of  some parts of Nepal to British.

On the otherhand, the Treaty of Titalia,1817 ceded, transferred and made full sovereignty to the Sikkimputte Rajahs, his heirs or successors, all the hilly or mountainous country situated to the eastward of the Mechi river and to the westward of the Teesta river, formerly possessed by the Rajah of Nepaul. This article I of the Treaty of Titalia 1817 shifted the power of sovereignty to the Rajah of Sikkim. It was ratified by the Governor-General in Council at Fort William on this Fifteenth day of March, One Thousand Eight Hundred and Seventeen.

Having said that the legal binding of article 5th of abovementioned treaty to the Nepalese after the loss of Anglo-Nepalese War was that the Rajah of Nipal was not allowed to engage with renounced parts or inhabitants. The resulted Nepali (Gorkhali) got separated and disconnected along with the land mass in the different parts of India. Further the British granted, in another writing in 1817, to the Rajah of Sikkim to make the laws and regulations to the territories in question which was ceded from the Nepal. Thus, the people who remain in the Sikkim are the aboriginal tribe of Sikkim with their land.
