This article examines the issue of recognition of minorities. His focus, however, is the recognition of the elderly as minority group to occur consequent respect for their citizenship. Discusses how this protection occurs for the elderly through legislation. Examines how public policies constitute an important alternative for the realization of positivized rights, as well as winning new rights. Highlights how this protection occurs by public policies. It also analyzes how the state plays the role of social control. Checks arises as a second chance for the understanding of social control to be exercised by civil society. It also discusses how this new context of social control can influence the role to be played by public policies in recognition of minorities, especially the elderly.
