The article deals with the consequences of the differentiated treatment given to microenterprises and small businesses on the environment of work and rights related to healthy living. Its objective is to analyze, based on data from the Reports of Work Accident Analysis prepared by Labor Auditors of the Regional Labor Management Bureau of Chapecó, if the definition of these companies, based only on annual revenues, is damaging the right of workers to provide services in a healthy and free of abusive risks work environment. The research is geographically delimited to the area of action of the Regional Labor Management Bureau of Chapecó and temporarily during the period from 2011 to 2015, with emphasis on construction activity. The methodology used is mediated by the inductive perspective, through consultation of primary sources. From the analysis of the fifty-two reports, it is concluded that the degree of risk and the environmental risk factors of the economic activity should be considered as defining criteria for applying the principle of favored and differentiated treatment for microenterprises and small enterprises, specifically regarding inspection of the norms regulating occupational safety and health.
